DUI – People v. Megan B.

Megan was accused of Driving Under the Influence and of refusing to provide a chemical test to the police, despite repeated attempts to give a breath sample. The police attempted to forcibly obtain a blood sample despite Megan’s objections and offers to cooperate. At jury trial, the jury rejected the police officer’s opinion that Megan was impaired and that she willfully refused to give a breath or blood sample. Megan was ultimately found not guilty on all counts.
